These Conditions of Use ("Conditions") apply to Pest Tools and supplement the Terms of Use. If there is a conflict between these Conditions and the Terms of Use, these Conditions control only with respect to beta, testing, pre-release, and feature-volatility issues.
1. Pre-Release Status
Pest Tools is a developing service that is continuously adding, testing, revising, and removing features. Certain functions may be labeled as beta, pilot, preview, test, experimental, early access, or may be released without that label but still operate as pre-release functionality.
2. No Production Reliance Without Review
You must independently review all outputs before using them in production or customer-facing workflows. This includes proposal text, generated PDFs, calculations, line items, descriptions, measurements, pricing, formatting, templates, file names, links, and saved records.
You agree not to rely on the Services as your sole source of truth for:
- legal terms or contract enforceability;
- pricing accuracy or tax treatment;
- engineering, construction, structural, environmental, or safety determinations;
- code, regulatory, licensing, or consumer-protection compliance; or
- records retention, backup, or audit requirements.
3. Feature Volatility
We may change or remove:
- features or tools;
- design, layout, and workflow behavior;
- proposal logic, templates, or export formats;
- available integrations;
- storage structure or retention behavior; and
- permissions, access rules, or usage limits.
We are not liable for losses arising from these changes.
4. Temporary Downtime and Maintenance
The Services may be unavailable due to scheduled maintenance, emergency maintenance, platform outages, third-party outages, testing cycles, bug fixes, migrations, or security events. We are not required to provide advance notice.
5. Data Integrity and Human Verification
Because the Services are still evolving, you are responsible for maintaining your own review and approval process before any document, quote, proposal, or communication is sent to a customer, vendor, employee, regulator, or other third party.
At a minimum, you should verify:
- customer identity and contact fields;
- scope and description text;
- selected items and quantities;
- measurements and calculation inputs;
- pricing and totals;
- company information, disclaimers, and signatures; and
- whether the final output reflects the current version of your terms and privacy language.
6. Third-Party Dependency Risk
Certain features may depend on third-party systems, including hosting, membership, storage, and document providers. A third-party failure, API change, permission issue, quota issue, account issue, or policy change may cause a feature to fail, degrade, or become unavailable without notice.
7. Testing Feedback
If you submit comments, testing notes, bug reports, screenshots, examples, workflow descriptions, or suggestions, we may use them to improve the Services without obligation or compensation.
8. Support and Response Times
Any support, troubleshooting, or issue response is provided on a commercially reasonable basis only. No guaranteed response time, repair time, escalation path, or service commitment applies unless we separately agree in writing.
9. Restricted Uses
You may not use the Services as a substitute for qualified legal, tax, accounting, engineering, safety, environmental, medical, emergency-response, or compliance review. The Services are not intended for high-risk use cases where an error, delay, or outage could result in bodily injury, property damage, regulatory sanctions, or material legal exposure without independent verification.
10. Security and Responsible Use
You must use reasonable safeguards to protect your account, exported files, shared links, and any personal or business information processed through the Services. If you discover a vulnerability, data exposure, or security incident involving the Services, notify us promptly at [CONTACT EMAIL].
11. Reservation of Rights
We reserve the right to throttle, suspend, disable, or remove access to any feature or account if necessary to protect the Services, enforce our policies, investigate abuse, respond to legal process, or address security, performance, or operational concerns.
